Making a Will can be an emotional and daunting task but is an important step in safeguarding the future for your loved ones.

 

A well-crafted Will provides protection and helps to avoid any disputes or problems dividing your assets after you are gone. 

 

Without a Will, you lose control over how your assets are handled and distributed.​

​A Will is a legal document that sets out your wishes for when you die.

​

You appoint Executors to handle your estate and your chosen beneficiaries to inherit. You may also include sections such as guardians or any specific gifts.

​

Without a Will, you lose control over how your estate is distributed.

A Trust can add an extra layer of protection to your Will.

 

A Trust works somewhat like a box - instead of the assets passing directly to your beneficiaries the assets go into the box (the Trust) for safekeeping, adding protection against various factors.

 

We offer three types of Trust:

1. Property Protection Trust

2. Discretionary Trust

3. Flexible Life Interest Trust

 

Property Protection Trust​

A Property Protection Trust, otherwise known as a Life Interest Trust, is a tool to ‘ringfence’ your property to protect it for your beneficiaries.

Common uses for this Trust include protection against hostile creditors or protection against remarriage.

The Trust allows for a person to remain living in the property without owning it (or a part of it). At the end of the Trust, the property passes to your chosen beneficiaries.

If you own a property with someone else, you must own the property as Tenants in Common in order for this type of trust to be effective.

 

Discretionary Trust​

A Discretionary Trust is a legal mechanism which allows the Trustees to manage assets for the benefit of the potential beneficiaries at their discretion.

The potential beneficiaries do not have an absolute right to any of the trust fund. The Trust can benefit a number of people which allows for flexibility as the Trustees can distribute assets as they see fit.

It is recommended that you write a Letter of Wishes to guide your Trustees.

Common uses for this Trust include protection against a beneficiary having a change in circumstances (such as marriage/divorce or financial hardship), as tax planning for unmarried or remarried couples, or to protect a vulnerable person who may not be able to manage their own inheritance.

Flexible Life Interest Trust

A FLIT is a combination of a Life Interest Trust and a Discretionary Trust. Your spouse/partner is given a life interest in the assets (the ability to benefit from the assets) during their lifetime.

When they pass away, the assets are held in a Discretionary Trust for your chosen beneficiaries. The Trust can benefit a number of people which allows for flexibility as the Trustees can distribute assets as they see fit. This protects the assets against many changes in circumstances (such as marriage/divorce or financial hardship).

This type of Trust is often referred to as the 'ideal modern family trust' due to the numerous benefits.

Your Will is a very important document. It should be kept safe as if it is lost or damaged in any way, it could be invalid.

  • Single Will - £20
  • Mirror Wills - £30

 

Taken by annual Direct Debit. You are free to cancel at any time.

​

We can store other documents such as LPAs or deeds.

​

You will receive a storage ID card and a copy of your Will for your records.

​

The storage package also entitles you to free amendments to your Will in the future.​
